Attorney Fee Law in Georgia—The Law of Lawyering

Every party in a court case dreads having to pay attorney fees and wants the other side to pay them.  Our lawyers can help you get your attorney fees paid by your opponent
The issue of who pays attorney fees in a court case in Georgia is a complex legal matter involving the application of the facts to the law.  A party may be entitled to have the other side pay their legal fees if the other side acted wrongly or if you have a contract requiring fee shifting.
Mr. Penland is a recognized expert on Attorney Fee Law in Georgia.  For over 20 years, Mr. Penland has taught Attorney Fee Law to hundreds of lawyers at the annual Abusive Litigation seminar for lawyers sponsored by the Georgia Institute for Continuing Legal Education.  Mr. Penland’s seminar paper, “ATTORNEY FEES UNDER O.C.G.A. §13-6-11” is one of the most authoritative and widely used treatises on attorney fee shifting law available for Georgia lawyers who need to know the real law on the subject.  Mr. Penland has deep knowledge and experience counselling and litigating not only O.C.G.A. §13-6-11, the general Georgia rule for attorney fee shifting in legal cases, but also the Abusive Litigation statutes of O.C.G.A. §9-15-14 and §51-7-80.
Mr. Penland often appears in a case as a special Co-counsel to the main attorneys to try the attorney fee issues in attorney fee hearings.  Mr. Penland also can act in a case as an expert witness on attorney fee issues.
In trying to get the other side to pay your attorney fees, it is important to start the planning and proof at the very beginning of the dispute to maximize your fee shifting chances, so call us or have your attorney call us early in your case.

  • I spoke with Mrs. Ruth about filing a case against my previous landlord for not returning my deposit. From the moment I answered the phone, she was in case mode. Her knowledge, expertise, and spirit exuded. She asked for details of my potential case and immediately offered assistance. It wasn't about her fee and how much I would be charged, it was about justice for a wrongdoing. Her integrity reaffirmed my confidence in the judicial system. I highly recommend Mrs. Ruth and would have no problem paying her fee to represent me in my civil matter because I'm confident in the results she would get for me. Absolutely worth every penny of her fee!!!!!!! Thank you Mrs. Ruth for your assistance!!!

  • Their knowledge of the law resolved an issue I was having with a crooked company. Not only did they give it readily; it was free of charge and without ask of gain for themselves. You all gained a client with that level of help and assurance, I would recommend you give them a call if you need real help.
